Grievances of Drivers and Artisans in Postal Department regarding fixing of pay since 4th CPC referred to the National Anamaly Committee for passing appropriate orders

                  Subject:    New Agenda item for discussion in the Meeting of the
                                    National Anomaly Committee.

      The Hon’ble High Court of Madras in its order dated 10.9.2009 in Writ Petition No.21367/2004 (grievances of Drivers and Artisans in the Postal Department with regard to anomaly in fixing pay since 4th Central Pay Commission followed by directorate dated15.12.2010 in Contempt Petition No.1371/2010 has directed that the matter may be referred to the National Anomaly Committee for its consideration and passing appropriate orders. Accordingly, Department of Posts has forwarded detailed Agenda Note on examination of the Claim of the cadre of Drivers deployed in Department of Posts for grant of pay scale equal to that of Postal Assistants working in the same Department in pursuance to direction of Hon’ble High Court of Madras.
      ‘In view of the position mentioned above, Secretary (P) in her capacity as the Chairperson of the Anomaly Committee has approved inclusion of the matter in the Agenda of the National Anomaly Committee. It is likely that this issue will be discussed in the next meeting of the National Anomaly Committee to be held in near future. A copy of the Agenda Note forwarded by the Department of Posts is enclosed for information and perusal please.

NATIONAL ANOMALY COMMITTEE MEETING HELD ON 15-2-2011 DE CESSIONS AND DISCUSSIONS

The third meeting of the National Anomaly Committee was held on 15/02/2011. The following items were taken up for discussion. No final decision on any item could be arrived at. It was more or less an exercise to understand the points of view of both sides on these items. We shall in our next communication indicate the outcome of discussion on each item.
Item Nos. 11, 12&13, 14, 20, 28,29&30, 31,37, 38,39, 40, 41, 43, 44, 45, 46, 49, 50 and 51.
During the discussion the Staff brought to the notice of the official side that the issues pertaining to the employees of Andaman and Nicobar islands, which were taken out of the agenda on the plea that the same would be discussed separately by a Committee to be set up by the Andaman Administration have not been settled. The NGO Association of A & N Islands have brought to the notice of the staff side that the A & N Administration has not taken any steps to resolve the problems even though similar issues pertaining to the employees of Pondicherry and Delhi were settled. The Official side has promised to take up the issue with the concerned in the Home Ministry to ensure that the issues are addressed expeditiously.
The official side has in the Action Taken State has indicated their inability to concede the demand raised by the Staff Side on the following two issues.
(a) Grant of increment in the case of employees whose increment falls between Feb and June. 2006.
(b) Fixing the pay of the promotees on par with the Direct recruits.
Though these issues were not discussed, the Staff Side has said that a resolution to them are urgently needed .
The official side has requested the Staff Side to indicate the items on which further discussions are needed; further details are required; and alternative suggestions could be made within 10 days so that the next and final meeting of the Committee could be convened before 31st March, 2011. It was also decided that the sub-committee of the MACP related issued will meet once again and their report submitted to the NAC .

RETIREMENT AGE FROM 60 TO 62


Will the Retirement age of central government employees go up from 60 to 62?
As we heard every time before the budget session of parliament, this time also a rumor about raising the retirement age of central government employees from 60 to 62 is spreading here and there among the central government employees. May be the officers at the verge of retirement be happy about this rumor. Otherwise there is no reason to be happy about this rumor.. As India is having 51% of people below the age of 25 years , it is not a good news to millions of jobless people. Sources close to the trade union movements and Federations told that there is no such proposal with the government since none of the workers federations have demanded it.
In 2009, The Manmohan Singh government was serious in weighing the pros and cons of increasing the retirement age for government employees from 60 to 62 years.That time it was believed that the finance ministry had prepared a detailed note on the issue and sent it to the prime minister’s office (PMO) But the government shelved the idea, largely because of fears that a higher retirement age would adversely impact employment generation and create resentment in the bureaucracy because of blocked promotional avenues. At that time, it was the Department of Personnel and Training (DoPT) that was asked by the PMO to study the issue and prepare a report.
The BJP led National Democratic Alliance government had raised the retirement age from 58 to 60, in 1998, a move that benefitted 90,000 government servants and 50,000 defence personnel. At the time, the logic was: the retirement of 140,000 employees would have cost Rs 5,200 crore whereas paying salaries cost only Rs 1,493 crore.
Incase if the decision is finally taken, it will only be the third time the government will have raised the retirement age. Jawaharlal Nehru was the first prime minister to have increased the age of superannuation from 55 to 58 following the 1962 war with China. The Atal Bihari Vajpayee government did it a second time in 1998.

Calculating entitlement to Earned Leave (E.L) and Half Pay Leave (HPL)

Sub:    Rate of calculating entitlement to Earned Leave (E.L) and Half Pay Leave (HPL).



      The undersigned is directed to say that matter regarding entitlement of a Government servant, who dies while in service, to Earned Leave under Rule 27(2)(b) and Half Pay Leave Rule 29 (2) (c) of the CCS (Leave) Rules 1972 has been under consideration of this Department.

2.       At present rule 27 (2) (b) says ‘when a Government servant is removed or dismissed from service or dies while in service, credit is allowed at the rate of 2 1/2 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service or dies in service.’

Similarly Rule 29 (c) says ‘When a Government servant is removed or dismissed from service or dies while in service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service or dies in service.’

3.       These rules adversely affect cases where the death of a serving Government Servant occurs on the last day of the month as the day of death is treated as his last working day. Clause (b) of sub rule (2) of rule 27 and clause (c) of sub-rule (2) of rule 29 of the CCS Leave Rules is modified as under :-

Rule 27 (2) (b) ‘When a Government servant is removed or dismissed from service, credit is allowed at the rate of 2 1 /2 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service. When a Government Servant dies, while in service, credit of Earned Leave shall be allowed at time rate of 2 1/2 days per completed month of service up to the date of death of the Government Servant.’ Rule 29 (2) (c) ‘When a Government servant is removed or dismissed from service, credit of Hall Pay Leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service. When a Government Servant dies while in service, credit of Half Pay Leave shall be allowed at the rate of 5/3 days per completed month of service up to the date of death of the Government Servant.’

4.      These orders take effect from the date of issue.


5.      So far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

Sub:  Request for up gradation of Grade Pay in respect of Head Clerks and Office    
          Superintendents on par with the CPWD – reg.

                                   It is submitted with due regards that as your good office is aware that till recent times there was no association / union recognized in Postal Civil Wing and the problems of Postal Civil Wing employees were unrepresented and unheard, because of which  they were not attended and given due importance. For instance, the 5th CPC recommended the pay scale of Rs. 5000  -  8000 to Head Clerks and accepted by all the Central Government Departments and implemented from 1-1-1996 where as in Postal Civil Wing orders have been issued only after the resolution passed by our association in the All India Conference held on 12-12-2010 and sent to the Directorate. It is brought to the notice of the eminent secretary of the department that in none of the similarly situated department s like CPWD and All India Radio Construction wing the designation of the Head Clerks has been changed as Assistants as is done in our department vide orders under reference, because the Head Clerks have been doing the supervisory duties and were having the support of sufficient staff working in the Correspondence Branch in Postal Civil/Electrical Divisions. It is not understood the reasons behind the re-designating the Head Clerks as Assistants in the Civil Wing of our Department unlike other similarly situated departments.

                               The organizational set up of Civil Wing is entirely different from other non secretariat organizations. Office procedures, duties of staff and officers, distribution of work, execution of works, following of specifications and every procedure   of Postal Civil Wing is alike CPWD. In particular the working pattern of staff in Postal Civil wing is similar to that of CPWD and distribution of work among staff in Postal Civil wing is as per CPWD. In fact the then P&T Civil Wing has born from CPWD. The Ministerial cadre of Civil Wing comprises of two supervisory posts namely Head Clerk and Office Superintendent in the Pre-revised scales of Rs. 5000 - 8000 and Rs.  5500 – 9000 respectively.
                          The 5th CPC while evaluating the duties and responsibilities attached to the post of Office Superintendents in CPWD and sewhere in Para 89.29 of its report has acknowledged that the duties and responsibilities attached to the post of Office Superintendents in CPWD are arduous and different in nature of job responsibilities. Similarly the responsibilities of Head Clerks of Postal Civil Wing are also arduous and different in nature of job responsibilities.  
                            The 6th CPC in its report submitted to the GOI made a recommendation for merger of the posts of Head Clerk and Office Superintendents and recommended the pay structure of Grade Pay of Rs.4200/- in the PB-2 to all these posts which were in the pre revised pay scales of Rs.5000-8000, Rs. 5500-9000 and Rs.6500-10500 respectively. However, the Government of India, Ministry of Finance, Department of Expenditure vide its OM No.1/1/2008-IC dated 13th November 2009 upon reconsideration granted Grade Pay of Rs. 4600/- in PB-2 corresponding to the pre revised scale of Rs.7450-11500 to all posts carrying pre revised scale of Rs.6500-10500 on 1st January 2006. Further, the Government of India, Ministry of Finance, Department of Expenditure vide its OM No.1/1/2008-IC dated 16th November 2009 has granted Grade Pay of Rs. 4600/- in PB-2 to the Assistants of CSS Cadre which has already been implemented.   Based on these recommendations and acceptance of higher GP to Assistants, the CPWD has already accepted the higher Grade pay of Rs. 4600/- to the Head Clerks and Grade Pay of Rs.4800/-to Office Superintendents for the first four years and thereafter a Grade Pay of Rs.5400/-.
                         The 6th CPC in its report, while recommending for maintaining of parity  in terms of the hierarchical structure of the Office Staff in the field up to the  level of Assistants in CSS recommended for grant of Grade Pay f Rs. 4200/- in PB -2 to both  Cadres. Now, since the Government of India, Ministry of Finance, Department of Expenditure vide OM No. 1/1/2008-IC dated 16th November 2009 in super cession of the aforesaid recommendation of the 6th CPC has taken a conscious decision to grant higher Grade Pay of Rs. 4600/- in PB -2 to the post of Assistants in CSS Cadre, the Head Clerk of Postal Civil Wing are also entitled to the grant of similar Grade Pay of Rs. 4600/-  as extended by the CPWD to their Head Clerks, and consequently, Office Superintendents are also entitled to the Proportionate enhancement in the pay structure of higher Grade Pay of Rs. 4800/- and Rs. 5400/- in PB – 2 and for which a conscious decision is to be taken by the department in consultation with the Ministry of Finance, Department of Expenditure in order to bring the parity in the pay structure as recommended by the Pay Commission and to remove the difference in pay structure between the similarly situated department CPWD.   
                     In view of the above submission our Association hereby makes a fervent appeal for the acceptance of the following justified demands in respect of the Head Clerks and Office Superintendents in Postal Civil Wing on par with the CPWD.
a.        To reinstate the designation of Head Clerks in Postal Civil Wing as in CPWD.
b.        To grant Grade Pay of Rs. 4600/- to the Head Clerks on par with Head Clerks of CPWD and Assistants of CSS cadre with effect from 1-1-2006.
c.        To grant Grade Pay of Rs. 4800/- and Rs. 5400/- to the Office Superintendents with effect from 1-1-2006.
                               There will not be much Financial burden on the GOI as the number of Head Clerks and Office Superintendents together in the Postal Civil Wing will not be more than 40 in the entire India.  
                            The granting of Higher Grade Pay to the Office Superintendents and Head Clerks of the CPWD and non granting of the same to the similarly situated Office Superintendents and Head Clerks in Postal Civil Wing is not only arbitrary but also amounts to hostile discrimination which is unsustainable in law being contrary to the mandate of Article 14 and 16 of the Constitution of India.

ELIGIBILITY OF PERMANENTLY DISABLED SON OF ACGHS BENEFICIARY TO AVAIL CGHS FACILITY


       The undersigned is directed  to  refer to the Office  Memorandum,  of even  number, dated the 31st May, 2007 and 29th August, 2007, vide  which  the entitlement of the son of a CGHS beneficiary beyond the age of 25 years was conveyed. As per the two Office   Memoranda   under reference,    it was indicated that a son of a CGHS beneficiary suffering from any permanent disability of any kind  (physical or mental) will be entitled to CGHS beneficiary even after attaining the age of 25 years. It  was  clarified    that  the   following    will   be  the disabilities, as defined in Section 2(i) of  "The persons  with   Disabilities  (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (No.1 of 1996)"  to   entitle a    son of a CGHS beneficiary to avail CGHS facility irrespective of his age:-

(i)           Blindness:
(ii)          Low-vision
(iii)         Leprosy-cured
(iv)         hearing                impairment
(v)          locomotor            disability
(vi)         mental  retardation:       and
(vii)        mental  illness

2.        Subsequent to the issue of the Office Memoranda   under reference, the Ministry of Health and Family Welfare has been   receiving requests   for   inclusion    of ailments like renal failure, autism, etc., within the definition of "disability" so that sons of CGHS beneficiaries could avail CGHS facility irrespective of the age of the son.

3.  After careful examination of the matter, it has been decided that the definition of permanent disabilities, of sons of CGHS beneficiaries, to avail CGHS facility be expanded as below:-

(i)           Blindness:
(ii)          Low-vision
(iii)         Leprosy-cured
(iv)         hearing   impairment
(v)          locomotor     disability
(vi)         mental  retardation:       and
(vii)        mental  illness

(ii) Disabilities defined in Clause    (i)  of Section 2        of National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation      and Multiple Disabilities Act, 1999 (No.44 of 1999), which presently covers a person suffering from any of the condition relating to autism, cerebral palsy, mental retardation or a combination of any two or more of such conditions and includes a person suffering from several multiple disability.

It is clarified that Permanent Disability" means a person with eighty per cent or more of one or more disabilities. In order for the son of the CGHS with permanent disability to avail CGHS facility, the other normal condition of dependency and normally residing with the CGHS beneficiary will continue to apply.

DEPARTMENT OF POST AND UNIQUE IDENTIFICATION NUMBER


Department of Posts is striving to provide complete solution for delivering the Unique Identification Number to all the residents in the country. A Statement of Intent is today being signed between Department of Posts and UIDAI in the presence of the Hon’ble Minister of Communications and IT and the Hon’able Chairman of UIDAI.
 
2. The main purpose of this Statement is to forge strategic alliance to create value for both the Department of Posts and the UIDAI and for the residents of India. 

Salient Features of Statement of Intent to being signed today, the 4th of February 2011 UIDAI wishes to leverage the national network of the Department of Posts to provide Aadhaar and the accompany authentication services to all residents.
1. Department of Posts and UIDAI wish to collaborate to provide state of art bio-metric and ID authentication services to the residents.

2. Providing of enrolment and updation facility to the residents of India in identified post offices across the country subject to economic & operational viability.

3. Facilitating continuing Aadhaar enrolment and provision of up-dation centres across the network of Post Offices subject to feasibility & on mutually agreed terms.

4. Transmission and delivery of UID letters to the residents of the country and providing proof of delivery of these letters through a service specially customized for UIDAI .

Use of Aadhaar and Aadhaar based authentication services in Postal business where deemed fit by Department of Posts;

5. Sharing demographic and biometric data collected during enrolment for Aadhaar on mutually agreed terms & conditions;

6. Utilizing Media Post and Direct Mail services of Department of Posts by the UIDAI to targeted group of residents across the country to promote Aadhar on mutually agreed terms & conditions.

7. In a recognition of the fact that Aadhaar enablement may call for running Proof of Concept and Pilot projects both side agree to do so where deemed necessary and subject to mutual convenience. Such exercises as may be undertaken in pursuit of this understanding will endeavour to produce Detailed Project Reports which can be effectively used to scale up the projects on successful completion.

The mandate of Unique Identification Authority of India (UIDAI) is to provide a Unique Identification Number to each and every resident of the country. This involves:-

a) Capture of demographic and bio-metric data of each and every resident.
b) Generating a Unique Identification Number for each resident of the country.
c) Printing a communication carrying the Unique Identification Number addressed to each resident.
d) Delivery of this communication to the resident.
e) Updation of resident’s data on a periodic basis.
 
4. Department of Posts has a vast network of post offices across the country which touches each and every resident of the country. The Department of Posts, therefore, is the only organization in the country that can provide an end to end comprehensive solution to the requirements of the UIDAI in this regard.
 
5. In view of above, Department of Posts and UIDAI came together and signed their first Memorandum of Understanding on 30th April, 2010. This MOU covers the following areas:-

a) Printing of communication carrying UID Number addressed to the resident at Department of Posts ‘Print to Post’ facility at Kolkata GPO.
b) Transmission of the UID communications printed at Department of Posts’ ‘Print to Post' facility to the addressee by the fastest means.
c) Delivery of the UID communication to the addressee through the vast network of post offices across the country.

6. The ‘Print to Post’ facility of Department of Posts at Kolkata is expected to print and dispatch about 1 crore UID letters upto March 31, 2011. During the year 2011-12, Department of Posts is expected to print and deliver about 12 crore UID letters.

7. Subsequently, Department of Posts signed the second Memorandum of Understanding with UIDAI on the September 18, 2010 wherein Department of Posts agreed to act as Registrar to UIDAI. UIDAI is in the process of shortlisting the Enrollment Agencies that will manage the Enrollment Stations in the identified post offices. More than 3700 post offices across the country have been identified for providing enrollment stations facility.

REVISION OF PAY SCALE, PAY BAND AND GRADE PAY OF HEAD CLERKS AND OFFICE SUPERINTENDENTS IN POSTAL CIVIL WING

The Head Clerks have been redesignated as Assistants as per the 5th CPC recommendations with effect from 1-1-1996 and the recommeded scale of Rs.5000 - 8000 is allowed to all Head Clerks w.e.f 1-1-1996 and the recommedations as per 6th CPC are accepted and orders issued by the Directorate for implementation on 28-1-2011.

In fact the Assistants in CSS are Group `B` Non-gazetted in PB 2:- Rs.7450 - 225 - 11500 ( Pre-revised ) With Grade Pay of Rs.4600-00.

AS per the recommedations of the 6th CPC Head Clerks are given grade pay Rs.4600/- and Office Superintendents are given grade pay of Rs.4800/- for thel first 4 years and later on Rs.5400/- in CPWD. Case will be referred to the Directorate shortly about the differences in Grade Pay of Head Clerks and Office Superintendents of our Postal Civil Wing and similarly situated department CPWD.

Inflation impact: Govt may hike tax exemption limit New Delhi, Feb 1 (PTI) Tax payers can expect some relief from high inflation in Budget 2011-12 as the government may raise the income tax exemption limit for individuals. "Finance Minister Pranab Mukherjee is alive to the price situation and its impact on the common man," sources said, adding he would favourably consider the issue of hiking tax exemption limit. Moreover, they said, as the government is committed to raise the income tax exemption limit from Rs 1.6 lakh per annum to Rs 2 lakh in line with the Direct Taxes Code (DTC) in 2012-13, tax payers could expect at least some relief in the upcoming Budget on February 28. "The finance ministry would keep in mind the high inflation in the Budget. Since there is no dearness allowance for a vast section of the society, hike in income tax exemption limit is likely," a source told PTI.
